Booking Agreement

About This Agreement

This Booking Agreement (“Agreement”) is entered into between the Client (the person or organization booking the talent) and the Talent (the performer, DJ, model, comedian, or other creative professional) facilitated through Hi-Rollerz Promotions (“Platform”).

By confirming a booking and proceeding with payment, both parties acknowledge that they have read, understood, and agree to be bound by the terms of this Agreement, as well as the Hi-Rollerz Terms of Service.

Scope of Services

The talent agrees to provide the specific services described in the booking request, including:

• The type of performance or service as listed on their Hi-Rollerz profile and agreed upon in the booking request.
• Performance at the agreed date, time, and location specified at booking.
• A minimum performance duration as agreed upon in the booking details.
• Any specific requirements or riders communicated and agreed upon prior to confirmation.

Any changes to the scope of services must be agreed upon in writing by both parties prior to the event date.

Payment & Deposit

• A 50% deposit of the total agreed booking fee is required to secure and confirm the booking.
• The remaining 50% balance is due no later than 24 hours before the event.
• A platform service fee set by Hi-Rollerz Promotions will be applied to the total at checkout. This fee is disclosed prior to payment.
• All payments are processed securely via Stripe. By making payment, the client authorizes the charge to their nominated payment method.
• Failure to pay the remaining balance by the due date may result in cancellation of the booking at the talent’s discretion, without refund of the deposit.
• All amounts are in Canadian Dollars (CAD).

Talent Responsibilities

The talent agrees and warrants that they will:

• Arrive at the venue no later than 30 minutes before the agreed start time for setup and preparation.
• Perform the services as described and agreed upon in the booking.
• Conduct themselves in a professional manner at all times.
• Notify the client and Hi-Rollerz immediately if any unforeseen circumstances may affect their ability to perform.
• Not be under the influence of alcohol or illegal substances during the performance unless explicitly agreed otherwise in writing by both parties.
• Bring all necessary equipment unless otherwise agreed in the booking details.

Client Responsibilities

The client agrees and warrants that they will:

• Provide a safe, legal, and appropriate venue for the talent to perform.
• Ensure the talent has access to the venue at the agreed time for setup.
• Provide any agreed-upon technical equipment, sound systems, or facilities as outlined in the booking.
• Not request the talent to perform any service that is illegal, discriminatory, or outside the agreed scope.
• Treat the talent with respect and professionalism throughout the engagement.
• Make timely payment as outlined in Article 2.

Cancellation Terms

• Client cancels 48+ hours before event: Deposit refunded minus the Hi-Rollerz platform service fee.
• Client cancels under 48 hours: No refund. Talent retains full deposit.
• Talent cancels: Full refund to client including service fee. Talent account flagged.
• Talent no-show: Full refund to client. Talent may be permanently removed from platform.
• Mutual cancellation: Both parties must agree in writing. Refunds determined by Hi-Rollerz on a case-by-case basis.

All cancellations must be communicated through the Hi-Rollerz platform messaging system to be valid.

Intellectual Property & Recording

• The talent retains all intellectual property rights to their performance, music, choreography, and creative works.
• The client may not record, broadcast, or distribute the talent’s performance without prior written consent from the talent.
• Any agreed-upon recording rights must be specified in the booking notes prior to confirmation.
• Unauthorized recording or distribution of the talent’s performance may result in legal action by the talent.

Force Majeure

Neither party shall be held in breach of this Agreement if performance is prevented by circumstances beyond their reasonable control, including but not limited to:

• Natural disasters, severe weather, or acts of God.
• Government-mandated lockdowns, curfews, or public health orders.
• Death or serious medical emergency of the talent or an immediate family member.
• Venue closure due to circumstances outside the client’s control.

In such cases, Hi-Rollerz will assess refunds and remedies on a case-by-case basis. Both parties are encouraged to rebook where possible.

Dispute Resolution

In the event of a dispute arising from this booking:

• Both parties must submit their dispute to Hi-Rollerz Promotions within 48 hours of the event date.
• Hi-Rollerz will mediate and issue a final binding decision within 5 business days.
• Neither party should initiate chargebacks, legal proceedings, or third-party mediation prior to completing the Hi-Rollerz dispute process.
• If mediation fails, disputes shall be referred to binding arbitration in British Columbia, Canada.

Indemnification

Each party agrees to indemnify, defend, and hold harmless Hi-Rollerz Promotions, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with:

• Any breach of this Agreement by either party.
• Any negligent or wrongful act or omission by either party.
• Any claim by a third party related to the booked event.
• Any violation of applicable laws or regulations by either party.

Governing Law & Entire Agreement

This Agreement shall be governed by the laws of British Columbia, Canada. This Agreement, together with the Hi-Rollerz Terms of Service, constitutes the entire agreement between the parties with respect to the booking and supersedes all prior discussions, representations, or agreements.

Any modification to this Agreement must be agreed upon in writing by both parties prior to the event date.
